1. About these terms
These terms of sale apply when you register, bid on, buy or make an offer for a vehicle on SecondCar ("we", "us"). Together with our auction rules, fees, privacy policy and acceptable use policy they form the contract between you and us. Please read them carefully before bidding.
2. Your account
- You must be 18 or over, resident in the UK and provide accurate details, including a mobile number where required.
- You are responsible for keeping your password secure and for all bids made from your account.
- We may verify your identity and may suspend or restrict bidding where we reasonably suspect fraud, non-payment or misuse.
3. Vehicle descriptions
- Each listing includes photographs, our inspection report, an HPI check and DVLA / MOT data. These form part of the description of the vehicle.
- Used vehicles show wear consistent with age and mileage. Inspection reports reflect the vehicle's condition on the inspection date and are not a guarantee of future performance or a substitute for a full mechanical survey.
- Mileage is recorded as displayed on the odometer and checked against available records; any known discrepancy is disclosed.
4. Bids and contracts
- A bid, Buy It Now purchase or accepted offer is a binding offer to buy the vehicle on these terms.
- A contract is formed when we confirm the sale by email (the "approval"). Where the reserve is not met we are not obliged to sell.
- We may cancel a sale in the event of an obvious pricing or listing error, in which case any payment received is refunded in full.
5. Price, fees and payment
- The total price is the hammer price plus the buyer's premium, any optional delivery charge and VAT where applicable, as shown on your invoice.
- Payment must be made by bank transfer, in full, within 48 hours of the invoice using the reference shown. We do not accept cash.
- Ownership passes to you only when we have received cleared funds. Risk passes on collection or delivery.
- If you do not pay on time we may cancel the sale, re-offer the vehicle and recover reasonable losses and costs, and may restrict your account.
6. Collection and delivery
- Collection is by appointment and requires photo ID matching your account. Vehicles not collected within 7 days of payment may incur storage charges.
- Delivery, where booked, is to a mainland UK address. Delivery dates are estimates.
- Please check the vehicle on handover and tell us about any discrepancy with the listing immediately.
7. Your statutory rights
- If you buy as a consumer, you have rights under the Consumer Rights Act 2015: the vehicle must be as described, of satisfactory quality (taking into account its age, mileage and the disclosed condition) and fit for purpose.
- Because vehicles are sold by online auction, the 14-day cancellation right under the Consumer Contracts Regulations 2013 may not apply to auction purchases; it may apply to Buy It Now and accepted-offer purchases. Your solicitor must confirm the position for your business model.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law.
8. Trade buyers
If you buy in the course of a business, the Consumer Rights Act 2015 does not apply and, to the extent permitted by law, vehicles are sold as seen and described in the listing and inspection report.
9. Complaints and governing law
Please contact us first at hello@secondcar.co.uk — we aim to resolve complaints within 14 days. These terms are governed by the law of England and Wales; if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
